Terms of Service

These Terms of Service (the "Terms") are a binding agreement between you and Frontier Roads LLC ("we," "our," or "us"), the operator of the HomePucks mobile application and related services (together, the "App"). They also serve as the end user license agreement for the App.
By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Who May Use the App
You must be at least 13 years old to use the App. If you are under the age of majority where you live, you may only use the App with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.
You may not use the App if we have previously terminated your account or if you are barred from using it under applicable law.
2. Your Account
You create an account by signing in with Google or Apple. You are responsible for the activity that happens under your account and for keeping your sign-in credentials secure. Notify us promptly at support@homepucks.com if you believe your account has been compromised.
You may delete your account at any time from within the App, which will remove your personal information as described in our Privacy Policy. Deleting your account does not undo a purchase. If you bought a League Pass for a league, that league keeps it for the season and you are not refunded — see Section 4.
3. What HomePucks Is (and Is Not)
HomePucks is an entertainment product. It lets you and your friends create private fantasy hockey leagues, make picks, and track results against publicly reported NHL statistics.
HomePucks is not a gambling service, sportsbook, or real-money contest platform. Points, scores, standings, and any in-App awards have no monetary value, are not redeemable for cash, prizes, goods, or services, and cannot be transferred or sold. We do not accept wagers, hold player funds, or distribute prizes. What you pay for a League Pass or an All-Star pass buys access to the App's software features for a season — it is not an entry fee, buy-in, or stake in any contest, and it is not pooled, held, or paid out to anyone.
If you choose to arrange any side agreement, wager, or prize amongst your own league members outside the App, you do so entirely on your own and at your own risk. We are not a party to it, do not administer it, and accept no responsibility for it. You are solely responsible for complying with the laws of your jurisdiction.
Nothing in the App is betting advice, financial advice, or a prediction of any real-world outcome.
4. League Pass, All-Star, and Payments
Joining a league is free. When a league needs to be paid for, one person pays for it — the commissioner, meaning the league's owner — by buying a League Pass for that league for that season. Everyone else in the league plays at no cost. There is also an optional per-person pass called All-Star. Everything is sold as an in-app purchase through the Apple App Store or Google Play.
- Nothing renews. A League Pass is a one-time, non-renewing purchase that covers a single league for a single season. It does not auto-renew, there is no billing period, and there is nothing to cancel. Access simply ends when the season ends. If the league plays again next season, someone buys a new pass then.
- Tiers and seat caps. A League Pass comes in three tiers, each with a cap on how many managers the league can hold: Small (up to 8), Standard (up to 16), and Pro (up to 32). Pro includes playoff mode. The tier names, seat caps, and prices are shown in the App before you buy, and in your app store account afterwards.
- Growing past your cap. If your league needs more seats than its tier allows, the commissioner upgrades to a larger tier. Upgrades are priced at the difference between the two tiers — you are never charged the full price twice.
- Playoff mode. Playoff mode is included with Pro. On Small and Standard it is a separate one-time purchase for the league. It costs $10 if the commissioner buys it before the league's season starts, and $20 at any point after that. It can be bought together with a Small or Standard League Pass in a single transaction, or added later on its own. Either way it covers one league for one season and does not renew.
- All-Star. All-Star is an optional $9.99 pass that covers one person for one season and lets you belong to more than one league you do not own. It is bought by you, for you, and it also does not renew — it ends with the season. Leagues you own never count against the free membership limit.
- Refunds. Payments are collected and processed by Apple or Google, not by us. We never see your payment details and we cannot issue a refund. Refund requests go to the applicable app store and are handled under its own policies. Except where required by law, amounts paid are non-refundable and we do not provide partial refunds for a season already underway.
- Price changes. We may change prices. A change applies only to purchases made after it takes effect — we will never charge you more for a pass you have already bought.
The free window. A new league is free for its first two scoring weeks. Everything works during that window: picks, standings, chat, and the rest. Payment is required at the moment the second week's picks lock. If no one has bought a League Pass by then, members can no longer make or change picks in that league — but standings, chat, and everything already earned stay readable. Nothing is taken away retroactively.
Promo codes. We sometimes issue promo codes that extend a league's free window and reduce the price of its League Pass. Codes are optional, expire, can be used a limited number of times overall and once per person, and a league season can hold at most one. A code can only be applied while the league is still unpaid — if the pass is already bought, the code no longer applies to it. We can withdraw or invalidate a code at any time before it is used.
Free members are never charged. Joining a league, making picks in it, reading standings, and using chat cost nothing. Only the person who buys a League Pass, an upgrade, an add-on, or All-Star is ever charged.
A League Pass belongs to the league, not to the person who bought it. Once a pass is bought, it is a property of that league for that season. It is not attached to your account, it cannot be moved to another league, and it cannot be taken back. If the person who bought it leaves the league, is removed from it, hands the league to someone else, or deletes their HomePucks account, the league keeps the pass for the rest of the season and the purchaser receives no refund, credit, or replacement. Deleting your account does not undo a purchase — see Section 2 and Section 11.
We may modify, suspend, or discontinue features at any time. If we materially reduce what a League Pass covers during a season that you paid for, contact us at support@homepucks.com and you may also request a refund from the applicable app store.
5. License to Use the App
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use one copy of the App on a device that you own or control, solely for your personal, non-commercial use. This is a license, not a sale — we and our licensors retain all rights not expressly granted.
You may not:
- copy, modify, translate, or create derivative works of the App
- reverse engineer, decompile, or disassemble the App, or attempt to derive its source code, except where applicable law expressly permits it
- rent, lease, lend, sell, sublicense, or otherwise commercially exploit the App or its content
- remove or obscure any copyright, trademark, or other proprietary notice
- scrape, crawl, or use automated means to access the App or extract data from it, or resell or redistribute any data obtained from the App
- probe, disrupt, overload, or attempt to gain unauthorized access to the App, our servers, or another user's account
- use the App to develop a competing product or service
6. Leagues, Picks, and Scoring
League owners can create leagues, invite members, configure settings, and remove members. If you join a league, other members can see your display name, profile photo, team name, picks (after they lock), scores, and chat messages.
Scoring depends on statistics we receive from third-party sources (see Section 8). Those sources are sometimes late, incomplete, or wrong, and they are occasionally revised after a game. We may correct, recalculate, or adjust scores, standings, pick locks, and results at any time — including retroactively — to fix errors or to reflect corrected data. We do our best to be accurate but we do not guarantee it, and we are not liable for the outcome of any league.
Deadlines, lock times, and game schedules may shift when the NHL reschedules, postpones, or cancels a game. We may void or reissue picks affected by such changes.
7. User Content and Community Conduct
"User Content" means anything you submit through the App, including chat messages, display names, team names, and profile photos. You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your User Content solely for the purpose of operating, providing, and improving the App. That license ends when you delete the content or your account, except for copies retained in routine backups or as required by law.
We have zero tolerance for objectionable content and abusive behavior. You agree not to submit User Content, and not to use the App, in any way that:
- is unlawful, defamatory, obscene, sexually explicit, or pornographic
- harasses, bullies, stalks, threatens, or intimidates any person
- promotes hatred, discrimination, or violence against any person or group, including on the basis of race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, or age
- infringes anyone's intellectual property, privacy, or publicity rights
- impersonates any person or entity, or misrepresents your affiliation with one
- contains spam, chain messages, malware, or links to malicious sites
- solicits or facilitates real-money gambling, wagering, or betting
- discloses another person's private information without their consent
Reporting and blocking. You can block another league member from within league chat, and you can report objectionable content or abusive users to us at support@homepucks.com or through the in-App reporting option. We review reports and aim to act on them within 24 hours. We may remove content and eject or ban users who violate these Terms.
We are not obligated to monitor User Content, but we may review, screen, filter, or remove any User Content at our discretion, without notice, and we may preserve and disclose it where we believe in good faith that doing so is necessary to comply with law, enforce these Terms, or protect the rights or safety of anyone.
User Content is created by users, not by us. We do not endorse it and we are not responsible for it.
8. NHL Data, Trademarks, and Third-Party Content
HomePucks is an independent product. It is not affiliated with, associated with, authorized by, endorsed by, sponsored by, or in any way officially connected with the National Hockey League (NHL), the NHL Players' Association, any NHL member club, or any of their affiliates or subsidiaries.
The names NHL, National Hockey League, Stanley Cup, the NHL Shield, and all NHL and NHL member club names, logos, marks, and uniform designs are the registered trademarks and property of the National Hockey League and its member clubs. Player names, images, and likenesses are the property of their respective owners. Any such names or marks appearing in the App are used solely for descriptive purposes — to identify the real-world teams, players, and games that the App reports on — and their use does not imply any sponsorship, endorsement, license, or affiliation.
Game schedules, scores, statistics, standings, player information, and news displayed in the App are factual information sourced from publicly available third-party feeds and news providers. Those sources are independent of us. We make no representation or warranty as to the accuracy, completeness, timeliness, or availability of any of that information, and third-party sources may change, delay, restrict, or discontinue availability at any time without notice to us. Your league results depend on this data, and we are not liable for errors in it.
If you are a rights holder and believe content in the App infringes your rights, please contact us at support@homepucks.com and we will respond promptly.
9. Our Intellectual Property
The App, including its software, design, text, graphics, the HomePucks name and logo, and all other content we provide (excluding User Content and third-party content), is owned by us or our licensors and is protected by copyright, trademark, and other laws. Section 5 describes the only rights you receive.
10. Privacy
Our Privacy Policy explains what information we collect and how we use it. By using the App, you agree to the practices described there.
11. Suspension and Termination
You may stop using the App at any time and delete your account from within the App.
We may suspend or terminate your access, with or without notice, if you violate these Terms, if we are required to by law, or if your use poses a risk to us or to other users. We may also discontinue the App entirely, in which case we will make reasonable efforts to give advance notice. If we terminate your access for a reason other than your breach, or we discontinue the App mid-season, you may request a refund for anything you bought and can no longer use through the applicable app store — we do not process refunds ourselves (Section 4).
Losing access to a league does not move its League Pass. If you leave, are removed from, or are banned from a league you paid for, the league keeps the pass for the season and you are not refunded.
Sections 3, 5, 8, 9, and 12 through 17 survive termination.
12. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY DATA, SCORE, STATISTIC, OR RESULT SHOWN IN THE APP IS ACCURATE, COMPLETE, OR CURRENT.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER WE NOR OUR OFFICERS, MEMBERS, EMPLOYEES, OR SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
14. Indemnification
You agree to indemnify and hold us harmless from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your User Content, your use of the App, your violation of these Terms, or your violation of any law or the rights of a third party.
15. Dispute Resolution and Governing Law
Talk to us first. If you have a problem, contact us at support@homepucks.com before filing a formal claim. Most issues can be resolved quickly. You agree to give us 30 days to resolve a dispute informally before starting any proceeding.
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. You and we agree that any dispute not resolved informally will be brought exclusively in the state or federal courts located in Colorado, and you consent to their personal jurisdiction — except that either party may bring an individual claim in small claims court. Nothing here deprives you of the protection of mandatory consumer-protection laws in your country of residence.
16. Apple App Store Terms
These Terms are between you and us only, not with Apple Inc. ("Apple"). If you obtained the App from the Apple App Store, the following also applies:
- Apple is not responsible for the App or its content, and has no obligation to provide maintenance or support for it.
- If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Apple is not responsible for addressing any claim by you or a third party relating to the App, including product liability claims, claims that the App fails to conform to a legal requirement, or claims arising under consumer protection or similar legislation.
- Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the App infringes that party's intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.
17. General
Changes. We may update these Terms. We will post the updated version here and change the "Last Updated" date. If the changes are material, we will give you notice in the App or by email. Continuing to use the App after the changes take effect means you accept them.
Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the App.
Severability. If any provision is found unenforceable, the rest stays in effect.
No waiver. Our failure to enforce a provision is not a waiver of it.
Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
